ESSENTIAL DATA

SECTION 1: INVOLVED PARTIES

This Service Agreement, made on the date above, is made between:

Seachange Care Support Services [ABN: 49 684 662 519]

AND

The Participant (name is listed below)

SECTION 2: THE NDIS AND THIS SERVICE AGREEMENT

This Service Agreement is made for the purpose of providing support under the participants' NDIS plan.
A copy of the participant's NDIS Plan is attached to this Service Agreement.

The parties agree that this Service Agreement is made in the context of the NDIS, which is a scheme that aims to:

  • Support the independence and social and economic participation of people with disabilities.
  • Enable people with a disability to exercise choice and control in the pursuit of their goals and the planning and delivery of their supports; and
  • A copy of the participant’s most recent NDIS plan must be provided to Seachange Care Support Services.

SECTION 3: SEACHANGE CARE SUPPORT SERVICES RESPONSIBILITIES

Seachange Care Support Services agrees to:

  • Once agreed on as stipulated in this Service Agreement, Seachange Care Support Services will provide you with services identified in your NDIS plan (see "Attachment 1: Schedule of Supports" below for more information).
  • Communicate openly and honestly in a timely manner.
  • Treat the participant with courtesy and respect.
  • Consult with the participant on decisions about how supports are provided.
  • Review the provision of supports at least annually with the participant and/or their legal guardian or nominated representative.
  • Plan and coordinate any transitions to and/or from our services.
  • Provide information on how to change or cancel supports.
  • Provide information about managing any complaints or disagreements that may arise and resolve problems quickly.
  • Provide details of Seachange Care Support Services Cancellation Policy.
  • Give the participant a minimum of 24 hours-notice if Seachange Care Support Services must change a scheduled appointment to provide supports.
  • Give the participant the minimum required notice of two (2) weeks if Seachange Care Support Services needs to end this Service Agreement (see "Ending this Service Agreement" below for more information).
  • Protect the participant's privacy and confidential information.
  • Provide support in a manner consistent with all relevant laws, including the NDIS Act 2013 and Rules, and the Australian Consumer Law.
  • Keep accurate records on the supports provided to the participant; and
  • Issue invoices and statements of the supports delivered to the participant as per the NDIA Terms of Business for Registered Providers as requested.

SECTION 4: PARTICIPANT / PARTICIPANT REPRESENTATIVE RESPONSIBILITIES

The participant/ participant representative agrees to:

  • Work with Seachange Care Support Services to ensure that services meet your needs.
  • Treat Seachange Care Support Services staff with courtesy and respect.
  • Communicate openly and honestly with Seachange Care Support Services.
  • Discuss any concerns about services being provided.
  • Provide Seachange Care Support Services with any plans and/or assessments necessary to deliver safe and quality services (e.g., Positive Behaviour Support Plan).
  • Reduce identified risks (e.g., within your home) when Seachange Care Support Services staff are delivering services
  • Pay all invoices for agreed services, transport, and/or other expenses within 28 days.
  • Give Seachange Care Support Services the required notice if you cannot make a scheduled appointment, noting that if the notice is not provided, Seachange Care Support Services cancellation policy will apply (see "Cancellation Policy" below for more information).
  • Give Seachange Care Support Services the required minimum notice period of two (2) weeks if you wish to end this Service Agreement (see ‘Ending this Service Agreement’ below for more information); and
  • Let Seachange Care Support Services know immediately if your NDIS plan is suspended or replaced by a new NDIS plan or if you stop being a participant of the NDIS.
